These Terms of Use ("Terms") are a legal agreement between you and us governing your use of the Yo Yo Yo application, website, and related services (together, the "Service"). By creating an account, ticking the acceptance box, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Your personal data is handled as described in our Privacy Notice, which forms part of these Terms. Because interactive sessions involve the processing of information about your emotional wellbeing, we will also ask for your separate, explicit consent to that processing before you begin (see Section 6).
2.1 Yo Yo Yo is a voice-based wellbeing and self-reflection application. It offers guided meditative content, reflective exercises, voice-based interactive sessions, and related creative tools.
2.2 Yo Yo Yo is not therapy, counselling, psychotherapy, medicine, or a medical device. It is not a substitute for professional mental-health or medical care, and no therapeutic, clinical, or fiduciary relationship is created by your use of the Service. We do not diagnose, treat, or cure any condition.
2.3 Yo Yo Yo is not a crisis service. The Service is not monitored by humans in real time and cannot summon help on your behalf. If you are in crisis or concerned you may harm yourself or others, do not rely on the Service: contact your local emergency services immediately (in the UK, dial 999) or a crisis support line such as the Samaritans (116 123, free, 24 hours) or NHS 111.
2.4 The "James" guide you hear is an AI-generated voice based on recordings of a real person. Conversational responses during interactive sessions are generated by artificial intelligence, informed by a body of meditative and philosophical source material. AI-generated responses can be imperfect, incomplete, or wrong, and should be treated as prompts for your own reflection, not as advice.
You must not use Yo Yo Yo while driving, operating machinery, or operating any vehicle or other equipment where your attention may be required.
Yo Yo Yo should only be used when you are stationary and seated in a safe and suitable environment where you will not be disturbed or placed at risk.
Before commencing any meditation or interactive process, you should ensure that you have sufficient uninterrupted time available. Certain sessions may take over 90 minutes to complete. You should not commence a session unless you are able to remain in a safe environment for the duration of the session.
You are responsible for ensuring that your use of Yo Yo Yo does not interfere with your safety or the safety of others.
3.1 You must be at least 18 years old to use the Service.
3.2 Yo Yo Yo involves reflective emotional work that can bring up strong feelings. It is designed for general wellbeing use by adults. If you are currently receiving mental-health treatment, have a history of trauma, psychosis, or dissociation, or are otherwise unsure whether deep reflective practices are appropriate for you, we encourage you to discuss the Service with your doctor or mental-health professional before use.
3.3 You are responsible for your own wellbeing while using the Service. You may pause or stop any session at any time, and we encourage you to do so if a session feels wrong for you.
You must not use Yo Yo Yo while driving, operating machinery, or operating any vehicle or other equipment where your attention may be required.

4.1 You must provide accurate information when creating an account and keep your login credentials secure. You are responsible for activity under your account.
4.2 You must not share your account or use another person's account without permission.
You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorised access to the Service or its systems; (c) record, extract, scrape, reverse-engineer, or redistribute the Service's content, including video, audio, session scripts, or the "James" voice; (d) use the Service to harass, harm, or impersonate others; (e) attempt to manipulate the AI into producing content unrelated to the Service's wellbeing purpose; or (f) resell or commercially exploit the Service without our written agreement.
6.1 During interactive sessions, the Service listens to your voice in order to guide your session. Your speech is transcribed, the transcript is used by an AI model to generate the guide's spoken response, and that response is converted to audio. This processing is carried out by us and by specialist service providers acting on our instructions, as described in the Privacy Notice.
6.2 What you say during sessions may reveal information about your emotional and mental wellbeing. Under UK data-protection law this is "special category data" and requires your explicit consent. You agree to give that consent through these Terms of Use (ticked checkbox). You cannot use interactive sessions without giving it; the non-interactive parts of the Service remain available to you.
6.3 You may withdraw your consent at any time via [settings location / email]. Withdrawal does not affect processing that took place before withdrawal, and it will mean interactive sessions are no longer available to you.
6.4 Your session words are processed transiently to deliver your session and are not stored after your session ends. We retain only non-content technical records (such as timings and error types) needed to operate the Service.
7.1 If your words during a session appear to indicate a risk of serious harm, the Service is designed to pause the session and present supportive resources, and a Support button is available during video segments.
When our safety feature activates, we record the following information in a secure CrisisIncident record: the session ID, the specific user message that triggered the safety response, the matched crisis terms, the severity level, and a transcript of the conversation segment surrounding the incident.
These records are retained for 12 months for critical safety-review and wellbeing-oversight purposes, after which they are permanently and irreversibly deleted from our systems. This limited retention ensures we have the necessary context to fulfill our duty of care and provide support where needed, while ensuring data is not held longer than required for safety management.
Precise Technical Confirmation
7.3 The safety feature is automated and can misfire in either direction. It does not contact emergency services, family members, or anyone else on your behalf, and it is not a monitoring, alarm, or duty-of-care service. Section 2.3 always applies.
8.1 New members receive a 5-day free trial. Card details are required at sign-up and are held securely by our payment provider, Stripe. No charge is made during the 5-day trial.
8.2 We will remind you before the trial ends. Unless you cancel before the trial ends, your subscription converts automatically to a paid plan at $19.99 per month or $169.99 per year, according to the plan you selected, and your card will be charged on that date.
8.3 Your subscription will continue to be billed on that cycle until you cancel.
8.4 You may cancel at any time via the Stripe billing portal accessible from your account settings; cancellation stops future renewals and takes effect at the end of the current billing period. Your consumer cancellation rights under the Consumer Contracts Regulations 2013 are not affected.
8.5 Prices may change on reasonable advance notice; any change takes effect from the next renewal after notice.
9.1 The Service and all its content — including video, audio, music, scripts, session methodologies (including Soul Field Intelligence), text, software, branding, and the "James" voice and likeness — are owned by us or our licensors and protected by intellectual-property laws.
9.2 We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own personal wellbeing during your subscription. All other rights are reserved.
9.3 Content you create in Yo Yo Yo Studio from your own material remains yours. You grant us the limited licence necessary to store and process it in order to provide the Service.
10.1 We aim for high availability but the Service is provided "as is" and "as available"; we do not guarantee uninterrupted or error-free operation, and features may change, be suspended, or be withdrawn.
10.2 We may update these Terms. For material changes we will give reasonable advance notice in the app or by email; continued use after the effective date constitutes acceptance.
11.1 Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including for death or personal injury caused by negligence, or for fraud.
11.2 Subject to 11.1: (a) the Service is provided for general wellbeing purposes only, and we are not liable for loss arising from reliance on the Service as medical, psychological, or therapeutic advice; (b) we are not liable for indirect or consequential loss, loss of profit, or loss of data; and (c) our total aggregate liability to you in any 12-month period is limited to the amounts you paid us for the Service in that period.
11.3 You use the Service at your own discretion and remain responsible for decisions you make about your own wellbeing.
12.1 You may stop using the Service and close your account at any time via the Stripe Billing Portal cancellation button found through the Manage Account button in the Hamburger menu.
12.2 We may suspend or terminate your access for material breach of these Terms, with notice where reasonably practicable.
12.3 On termination, Sections 9, 11, 13, and 14 survive.
These Terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident elsewhere you retain any mandatory protections and forum rights of your country of residence.
